Incomplete or improperly submitted notices may be delayed or deemed invalid.

2) Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will promptly review the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material. When feasible, we will notify the affected user or content provider and provide instructions for submitting a counter-notice.

We aim to respond to properly submitted notices within 2–3 business days during our operating hours (Daily, 10:00 AM–7:00 PM PT).

3) Counter-Notice Procedure

If material you posted was removed or disabled and you believe the action was taken due to mistake or misidentification, you may submit a counter-notice containing the following:

  • Identification of the material that was removed or disabled and the location where it appeared before removal.

  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.

  • Your full legal name, mailing address, telephone number, and email address.

  • A statement consenting to the jurisdiction of the United States District Court for California (or, if you reside outside the U.S., consent to that court’s jurisdiction) and agreeing to accept service of process from the original complainant or their agent.

  • A physical or electronic signature.

Unless the original complainant files a court action seeking to restrain the allegedly infringing material, we may restore the content within 10–14 business days after receiving a valid counter-notice.

4) Repeat Infringer Policy

In appropriate circumstances, and at our sole discretion, Ecobriqueafrica Store may suspend or terminate access to the Site for users who are determined to be repeat infringers.

5) Misrepresentations (17 U.S.C. §512(f))

Any person who knowingly misrepresents that material or activity is infringing—or that material was removed or disabled by mistake or misidentification—may be subject to liability for damages, including costs and attorneys’ fees.

6) Handling of Notices

We may share a copy of a DMCA notice or counter-notice (including contact information) with the party responsible for the content so they may understand and respond to the claim. We may also retain records of notices and actions taken for legal compliance and auditing purposes.
